TERMS & CONDITIONS

General

The conditions set out below apply to each and every safari/tour. Reference or mention of the 'operator' means Lyon Tours & Safaris cc (No: 2008/059879/23). The transport, meals, entrance fees, accommodation or other facilities or services which are to be supplied in respect of any tour or safari are those specifically stated on the website, in the tour brochure or tour/safari itinerary.

Costs

Lyon Tours & Safaris cc quotations are based on anticipated costs and are subject to amendment should these anticipated costs increase due to circumstances outside the control of the operator.

Deposit/Payments/Booking

A 25 % non refundable deposit is required upon booking a safari or tour and the balance is payable no later than 30 days prior to the departure of the safari and/or tour. In the event of a booking less than 30 days prior to the start of the tour/safari, payment in full is to be made upon booking the safari or tour. Any booking without the aforesaid payment shall be unenforceable and unconfirmed.

Cancellation

If the reservation is cancelled by the client, cancellation fees will be due and payable according to the following:
30 to 45 days prior to planned departure date, a refund of the amount paid in excess of the non-refundable deposit.
21 to 30 days prior to the planned tour departure date, a refund of the amount paid in excess of the non-refundable deposit plus 25 % 21 days or less to the planned tour departure date, no refund.
If the reservation is cancelled by the operator, who reserves the right to do so in its discretion, then the full amount paid, shall be refunded to the client.  

Refunds

Once the tour/safari has commenced, refunds will not be made for missed tours, meals or other special activities.

Travel and Accommodation Arrangements

All travel and accommodation arrangements, such as flight bookings, reservation of hotel accommodation, reservation of motor transport, etc. made by the operator are subject to the booking conditions and cancellation provisions of the supplier of the services, transport and accommodation, etc.

Alteration of Routes and Substitution of accommodation. Whilst Operator takes every care to ensure that itineraries are followed through to the letter, unforeseen circumstances may necessitate changes, and the operator reserves the right to make the necessary alteration or substitution.

The operator accepts no liability to the client due to the alteration of routes or substitution of accommodation. Where accommodation is substituted, it will be substituted for similar accommodation.

If sickness or accident interrupts a tour, the operator shall not be liable for any cost or expense arising there from, save only to the extent that such sickness or accident was caused by the operator's wilful act or gross negligence. The operator shall not be liable for any refund, either total or partial, of passage money paid. The operator recommends clients to take out necessary insurance's to protect the clients against such eventualities.

Any claim against the operator shall be delivered in writing to the operator within 3 (three) days of the loss, failing which the claim will be time-barred. Any claim shall be limited in quantum to R200.00 per incident, accordingly clients are advised to be fully covered by insurance.

Client Responsibility

Clients may not carry any unlawful or prohibited articles or substances whilst on tour with the operator.

If any client offends against the prohibitions set out herein, the operator will be entitled to immediately exclude the offender from the tour, who will be responsible for his or her own repatriation and all costs thereof. The operator will under no circumstances assist any such offender in any dealings or negotiations with any authority in respect thereof.  

Jurisdiction

In all matters where it is or may be necessary to have recourse to the Court, the Courts of the Republic of South Africa shall have sole jurisdiction to the exclusion of the Courts of any other country and the prevailing law of the Republic of South Africa shall apply to the agreement and any disputes or claims arising there from.

Detailed description of goods and/or services

Lyon Tours & Safaris is a business in the tourism industry that markets South African travel.

Delivery policy

Subject to availability and receipt of payment, requests will be processed within 7 days and delivery confirmed by way of booking voucher.

Return and Refunds policy

The provision of services by Lyon Tours & Safaris is subject to availability.  In cases of unavailability, Lyon Tours & Safaris will refund the client in full within 30 days. If the reservation is cancelled by the client, cancellation fees will be due and payable according to the following:
30 to 45 days prior to planned departure date, a refund of the amount paid in excess of the non-refundable (25%) deposit.
21 to 30 days prior to the planned tour departure date, a refund of the amount paid in excess of the non-refundable (25%) deposit plus 25 %

21 days or less to the planned tour departure date, no refund.
If the reservation is cancelled by the operator, who reserves the right to do so in its discretion, then the full amount paid, shall be refunded to the client.

Customer privacy policy

Lyon Tours & Safaris shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, "personal information" shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA).

Payment options accepted

Payment may be made via Visa & MasterCard credit cards or by bank transfer into the Lyon Tours & safaris bank account, the details of which will be provided on request

Credit card acquiring and security

Credit card transactions will be acquired for Lyon Tours & Safaris via PayGate (Pty) Ltd who are the approved payment gateway for Standard Bank of South Africa.  PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no credit card details are stored on the website.  Users may go to www.paygate.co.za to view their security certificate and security policy. 

Customer details separate from card details

Customer details will be stored by Lyon Tours & Safaris separately from card details which are entered by the client on PayGate’s secure site.  For more detail on PayGate refer to www.paygate.co.za

Merchant Outlet country and transaction currency

The merchant outlet country at the time of presenting payment options to the cardholder is South Africa.  Transaction Currency is South African Rand (ZAR).

Responsibility

Lyon Tours & Safaris takes responsibility for all aspects relating to the transaction including sale of services sold on this website, customer service and support, dispute resolution and delivery of goods

Country of domicile

This website is governed by the laws of South Africa and Lyon Tours & Safaris chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature,  . . . . . . . . . . . . . . . . . . . . . . .

Variation

Lyon Tours & Safaris may, in its sole discretion, change this agreement or any part thereof at any time without notice.
